Terms and conditions of sale

1. Purpose

They set out the rights and obligations of seller and buyer in an online sale. They apply to every product offered on the site, engraved jewellery and personalised posters alike.

2. Products

Products are described and shown as accurately as we can. Photographs are not contractual: colours vary from one screen to another, and every piece is made by hand.

Some pieces are personalised to order — an engraved name, a date, a symbol, the map of a place, a sky or a route chosen by the customer. They are made specially and are not held in stock.

3. Prices

Prices are shown in euros, all taxes included. Delivery costs are added and shown before payment is confirmed.

Compagnie des Blasons may change its prices at any time; a product is invoiced at the price in force when the order is confirmed.

4. Orders

Orders are placed online. An order is firm once payment is accepted; a confirmation e-mail is then sent to the address given.

The seller may cancel an order in the event of a payment problem or a clearly fraudulent order.

5. Payment

Payment is made when the order is placed, by card or by one of the means offered on the payment page. Payment is handled by our provider Mollie B.V. on its own servers: no card number passes through or is kept by us.

6. Making and personalisation

Personalised products are made only after the order, from the information given by the customer: spelling, dates, symbols, places, routes, poster texts. That information is treated as final.

The summary shown before purchase repeats those entries; it is for the customer to check them. An engraving or a print that matches the customer’s entry cannot be redone at our expense.

7. Delivery

Orders are shipped to the address given by the customer. Making and delivery times are set out in our shipping policy.

The seller cannot be held liable for delays caused by the carrier.

8. Right of withdrawal

Non-personalised items. The customer has fourteen days from delivery to withdraw, without having to give a reason. The item must be returned unworn, in perfect condition and in its original packaging, after contacting us at marceletlesblondes@gmail.com.

Personalised items. Under Article L.221-28 3° of the French Consumer Code — which transposes Article 16(c) of Directive 2011/83/EU — goods made to the consumer’s specifications or clearly personalised are excluded from the right of withdrawal. They are neither taken back nor exchanged, except for a manufacturing defect or an error on our part.

9. Guarantees

Every product carries the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). These apply to personalised products as much as to any other.

10. Claims and damage

The customer checks the condition of the parcel on delivery. If a product is damaged or does not match the order, they contact the seller within seventy-two hours, with photographs.

11. Refunds

Once an eligible returned product has been received and examined, the refund is issued within ten working days to the original means of payment.

12. Personal data

Data collected is used to handle the order and customer service. See the privacy policy.

13. Intellectual property

The contents of the site remain the exclusive property of Compagnie des Blasons. Reproduction is prohibited without authorisation.

14. Consumer mediation

Under Articles L.612-1 et seq. of the French Consumer Code, any dispute not settled by our customer service may be submitted free of charge to the mediator CM2C: www.cm2c.net, cm2c@cm2c.net, CM2C, 49 rue de Ponthieu, 75008 Paris, France.

The customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

15. Governing law

These terms are governed by French law. A consumer resident in another European Union country keeps the benefit of the mandatory provisions of their country of residence. Failing an amicable settlement, the French courts have jurisdiction.
